Legal Question in Family Law in California
parental rights
An attorney has advised the father of my 14 mo. old that it's possible for him to terminate parental rights because the father and baby have never bonded (they've never seen each other in person). Is this possible? Can a parent terminate parental rights that easily?

Re: parental rights
Either the attorney does not know what he is talking about or the father of your 14 month old is lying. He is not obligated to exercise his "parental rights", however, he is obligated to take care of his parental responsibilites, such as supporting the child. Terminating parental rights does not terminate parental responsibilities. You should bring an action for child support, and soon. Good Luck, Pat McCrary
Re: parental rights
Parents cannot terminate parental rights just because they want to. In fact, the Family Court doesn't even have the power to do so - it takes the Children's court ( Moterey Park in Los Angeles) to do so.
Don't listen to the father. Go right ahead and look for the support your child needs and deserves.

Re: parental rights
Under California law the duty to pay child support is stopped only if the court terminates parental rights. The court normally does that only if there is another person there to take the place of the parent being released. The lack of contact and bonding between father and the child will not release him from his child support duty.
