I am trying to get custody of my son in California -- I live in Minnesota. The mother has left her teenage kids, my son (9) to her 20-year-old son. The mother doesn't spend any child support on my child, leaves the country continuously, will not let me see his living conditions, will not let him call me, talk to me most of the time. If I don't win in court with all this neglect, I want to give up my parental rights - the mother will ruin the child. Will I still be obligated to pay child support (I'm not in arrears). She refuses to work and lives with her boyfriend.

I think you would win, if the circumstances are as you say they are. File an Order to Show Cause for Modification (assuming that you already have orders on file) and go for custody.

I would suggest that you retain an attorney in the county where your son lives. Your chances of winning are good based on the facts that you give. If you give up your parental rights you still have parental obligations, such as paying child support. Good Luck, Pat McCrary

Why wouldn't you win under those circumstances? Pull out all the stops and go get custody of your child.
