Legal Question in Family Law in California
Parental Rights
I was recently a victim of a false molestation alligation brought fourth by my 14 year old daughter.
My daughter retracted her alligation and the criminal case was dropped. However CPS is still trying to pursue a case. So far nobody seems to be intrested in the truth and I have never been asked my side of the story. CPS is in the process of returning my daughter to me. I feel I need to continue to collect evidence to protect me. I have a strong suspition that my daughter is having sex and has lost her virginity. This may explain why she made up the alligation. She has a form of ocular Herpes that caused 2 docters to suspect that she was having intercourse with a infected person(s). She has also been claiming that she is bi-sexual. Question: Do I or my wife have the right to force my daughter to undergo a pelvic exam to determine her virginity status and possiably to collect evidence of whom the other party may be? I suspect he or she is an adult.
Can I request photos? to keep available should I need to defend myself against this type accusation again?

Re: Parental Rights
You can file a motion with the court to recover costs of a false abuse claim. You can also get custody over a false claim.
Good luck.
As always contact an attorney in your area if you have additional questions.
