Legal Question in Family Law in California

parental rights after signing over guardianship

Two children were taken away from there mother (ages 7 and 10) The court already has decided the mother will not get the children back. The Grandmother wants custody, but the fathers live in Sacramento and the Grandmother lives in Los Angeles. Both children want very much to live with the grandmother. The fathers of these two children have never been in their lives. The seven year old girl's father was convicted of molesting a 6 yr. old girl about 5 years ago. (This would not be admissable in court thoough). What are the chances of the grandmother obtaining cutody?

Re: parental rights after signing over guardianship

Based on the information that you provided you should have a good chance of winning. You have two factors in your favor: 1. the courts normally want to keep the children together, when they have been living together; 2. the fact that the father of one of the children has been convicted of molesting a child is relevant to his bid for custody. It is unlikely that the court will give him custody, because of the risk of his molesting the daughter. You need an attorney that has experience in this area of the law.
