Parental Rights Termination

I would like to have my ex-husbands parental rights terminated. There is a court order from 6 years ago in San Diego court for visitation but I have sole physical and legal custody. He has been no where to be found in 5 years. Do I need to amend the original order in San Diego or do I file a new order in El Dorado County which is where the child is a resident now?

You may have it done quicker and easier in San Diego, especially since your X's last know address was mostly likely a San Diego address and you may have to serve by publication in San Diego. Your appearance will not be necessary. Call me directly at (619)222-3504.

The best proceedure would be to apply to the court from where there wwere the orders. the court has the better jurisdiction to entertain your prayer.

The proper procedure is to either go to the San Diego county family court or to have the court change venue to Eldrado county. Moving the case to Eldrado county is simple if your ex no longer lives in that county. There is a filing fee that has to be paid in San Diego county and a filing fee in Eldrado county.
