parenting plan

I have a curent parenting plan in Wa state. Last August I moved form WA to Ca with my daughter. Her father and I were disputing a new parenting plan. It was last left to him to ask for a hearing. A year has passed and he has not responded and has also not seen our daughter. How do i move the case to Ca? I want a new parenting plan also, becuase his involvment is now non existant.

Moving the custody case from Washington to California will be difficult. The Uniform Child Custody compact requires the case to remain in Washington so long as one parent remains in Washington. The court in California has jurisdictio over the child as the child is currently living in California, However, California will defer it jurisdiction to Washington unless both courts agree that California is the best jurisdiction. That is unlikely to occur when the child has been in California for only a short time. This is a complex area of the law. You should consult an attorney about the facts of your case.
