parenting rights before court judgement

Hi,

My child is 2 years old and feels very insecure when he has to stay overnight at his dad's place. In the process of a divorce, do I have the right to want the child to spend all nights with me?

You will have to present more than my child is not comfortable staying alnight with father.

The relationship between the child and father will have to be presented to the court. That is how much time does the child spend with the child. The best approach would probably be to request that the overnights be at the end of a transition plan. That starts with only day time visits slowly advancing to all day and then overnights. A request to review the overnight visits may be something that you can get the court to order. This approach may not be the best for your case. You should consult with an attorney to cover all of the facts of your case.
