Legal Question in Family Law in California

parenting rights before a court order

I have a court date for father visitation schedule and child support in a few months. The child is 2 years old. My soon-to-be-ex calls me and tells me that our child will sleep at his house after he picks him up from daycare. We have never agreed to having the child spend week nights at his father's place. The father is trying to convince me that the child wants to sleep there every time he goes there. What can I do to stop that?

Re: parenting rights before a court order

If there is a court order for visitation, and it does not provide for overnight visits, then you can enforce the order. If there is only your agreement then you would have to get a temporary order preventing the overnight visits. Unless you have evidence that overnight visits will be harmful to the child, your chances of getting such an order is slim. Contact an attorney and discuss this matter.
