Legal Question in Family Law in California
When both parents are deceased
My daughter passed away recently leaving 4 children ages 8-14,and their father passed away 7 years ago. In order to collect any life insurance for the children, we were told we have to get legal guardianship of them. How is the easiest and fastest way to go about this? The children and their mother have been living with us for about 5 years.

File a petition for guardianship with the court. Be sure to include the fact that the children have lived with you for the past 5 years. Also contact the social security department regarding filing for social security benefits for the children. Did your daughter have a will that appointed you and the guardian of the estate and person of the children. If so this should be a great help in obtaining guardianship.
