Ex Parte Declaration

My daughter has been living with her dad, is desperate to return home to me this summer. I filed an Order To Show Cause and got a Court date for 9/6/02. That is after her next school session starts and her dad wants to send her to a different school closer to his home which she does not want to do. He doesn't follow Court Orders but comes off as such a concerned parent while visciously slandering me. He also can not control his temper which results in my daughter being physically abused. I am quite certain my daughter will be able to move back with me once we have our hearing. I would like to be granted an ex parte hearing to expedite her return. I need to know the best way to word my ''Facts In Support Declaration'' Attachment to Order To Show Cause that would motivate the judge to grant me the ex parte hearing. Thank you

If you try this on your own, you are jumping into a pit where the bottom is not known. You need to hire a professional who can advance the case and help you portect your daughter. You wouldn't pull your own tooth would you, and your daughter is more important than a tooth. If she is being abused, call CPS and they will investigate and may remove your daughter and give her to you. Good Luck, Pat McCrary
