Legal Question in Family Law in California
How do I keep partial child custody?
Currently my girlfriend & I live together. We have a child together, but I don't want to live with her any longer. My question is. What do I need to do to protect my rights as a father and still have partial child custody? Do I need to pay child support if we are sharing custody?

Support is determined by a program that compares your income with hers and the amount of visitation each parent is granted. The problem is that if the child is young and she(girlfriend) has not had a significant job, you could be stuck with little visitation and a hefty support payment every month. You will need an attorney for these issues. Don't wait until you get a result you are unhappy with, because it will cost more to undo it than to have it done right the first time around.

The answer may depend upon the age of the child, as well as other factors. I suggest that you consult with an experienced family law lawyer immediately.
Good luck to you.

I have many clients that are in the same situation. There are many things that you need to do to protect your rights as a father because you do have rights. However, many factors go into affecting your rights. Before you do anything I suggest that you speak with an attorney to understand how your decision will affect you and your child's life. Give me a call if you wish to discuss the matter, I would be happy to discuss it with you. Unless you have "skeletons in your closet" you should be able to get joint legal custody.
