Legal Question in Family Law in California

do all parties have to be in court for trial

i am in the process of terminating guardianship from my parents and we are set for trial in aug. my father is going into back surgery on wed and my stepmother wants to postpone the trial until a later time but this has been going on for a year now and the court set trial before the new school year starts, my question is does my father and stepmother both have to be at trial or can it just be my stepmother? will a judge postpone because of his surgery or keep it like it was first set to start before the school year.

Re: do all parties have to be in court for trial

His presence would be required only if he was a witness. Then he would have the right to be present and request that the trial be postponed. You did not state how long the continuance would have to be to accomodate his medical treatment. If it is only a short continuance then he will probably get the continuance.
