Legal Question in Family Law in California
My ex partner and I were never married, but have a son together whom I have 100% of the time. Father moved to another state, married and had a new baby, is very inconsistant with his contact efforts and financial support of our child. I have recently been given the oppertunity to start a new life In New zealand and have filled out the custody papers already, just want to know what my best course of action is for my children and I to move on to a better life. I am scared he will fight it and our lives will then have to evolve around his selfishness. My state is California and where our son was born, the father currently resides in Arizona. Any help would be grately appreciated. Need best course of action, additional papers i should file and even how to fight this case to be successful. Father is a possible flight risk also as he is a Mexican citizen and has strong ties to that country.

The core issue for parenting is ensuring the child has access and contact with both parents. I would stress in the papers the arrangements you plan to put in place if you move to New Zeland that would facilitate contact between father and son. Examples of contact is setting up and paying for travel flights, having Skype video phone contact and other means of communication and visits for a successful and continuous parenting relationship.
