Me and my partner are planning to file a divorce. We are in a same sex marriage. What are my rights when it comes to the house? My partner bought the house a few months before we got married. Had the paperworks done and moved in after we got married. Her name is on the mortgage and the title. Can she evict me immediately? Do I have an interest to the house? I head there's a new California law when it comes to dealing with pet custody in divorce. Can you tell me more about it? What are my options for spousal support? I earn less How about health insurance? Will I get cut off immediately? I'm under my partner's insurance

If you are not on title to the house, it is all hers. You may be entitled to some small cash pay out for money put toward the mortgage principal out of earnings during the marriage. The 2019 pet law made a slight change. The court can now consider the best interests of the pet, in addition to the other factors that go into dividing up everything a couple owns. Before the pets were just treated as property, same as the coffee maker. Spousal support depends on length of marriage. Without that number, that's all I can tell you. Upon filing of a divorce petition and service on the other spouse, an automatic restraining order goes into effect prohibiting, among other things, making any insurance changes until the court orders otherwise.
