Legal Question in Family Law in California

can the past hurt

my boyfriend is going through a custody battle. his wife is trying to take custody from him based on that I was accused of child abuse and neglect a couple years back but i was aquitted and granted custody of my own child. Can this hurt him in trying to get full custody of his child? my boyfriend lives with me and his son stays with us when he has him.

Re: can the past hurt

Yes it could. You stated that you were acquitted, that indicates that there was a trial and the jury found you not guilty. The standard of proof in a criminal trial is beyond a reasonable doubt, in a custody case the standard of proof is much lower. How or to what degree it will affect his bid for full custody is difficult to say without much more information about his relationship, and mom's relationship with the child. The facts of your case would also have to be considered.
