paternity change of venue of unborn

my ex girlfriend became pregnant and was unsure of who the father was. after a few discussion it became clear that she didn't care who the father was she was a mother. I requested some information on the types of test that she was taking to eliminate me as the father but was always given accounts and dates that made no since finally I asked for a dna test and she would not. every month for three months I would as politely as possible inquire for a letter from her physican atleast identifying the date of conception. she finally refused to submit to a dna test, I filed suit in my county. to my dismay her attorney counters that I have filed in the wrong county due to the child not being born and that I should have some papers signed and forwarded to her for dismissal with prejudice. I have disagreed and am willing to pay for the dna test but not her legal fees as she had many occassions to resolve this out of court. Am I right? and do I have to refile in a different county? thank you for your input and advice.
