Legal Question in Family Law in California
Paternity and child support
I am a single mother and full-time college student and am on public assistance in CA and my son's father is in WA. A child support order has been established and ha signed the Parentage paperwork when our son was born. He told me the case has now been moved to WA and any court cases will be in WA now, is this true? Also, he would like a paternity test and is insuating he is going to cheat it to beat it, Can this happen? Also, he would like to sign over parental rights, but I was told since he owes child support he is not allowed to do this, but he said he talked to a lawyer from WA and and it could be done... Is all of this true? Also, should I be looking for an attornet for these matters?

Re: Paternity and child support
Nothing he's telling you is true. He has apparently been validly served with the CA child support action, he has to fight the paternity in CA. Any custody issues would likewise have to be heard in CA. Sounds like he may have already waived his right to paternity testing, but the clock is ticking so if he hasn't waived it yet, he needs to take action or he'll lose the right to. If you have a case with CSSD, they will turn over the CA order to the WA version of CSSD, they will register the action in WA and pursue him in WA for support, it is still a CA case. No, he can't terminate his parental rights, that's not his choice.
