Legal Question in Family Law in California

Paternity/ Child Support

My son will be four years old in March. His father signed teh child support judgement in 2006. Has never denied parentage of the child. Now, all of a sudden he is claiming to have taken a home DNA test that proved that my son isn't his. He is mistreating my son, and demanding that I take him off of child support. My son loves his dad. What are my rights? What are dad's rights? What can I do?

Re: Paternity/ Child Support

If he is mistreating your son you have a duty to protect him from his father. If you continue to fail to protect him your child maybe removed from you and placed in foster care.

it may be too late for him to get out of paying child support--i'd have to do some research to be certain. nevertheless, if he refuses to act like a father, then there's nothing you can do from a legal perspective.
