Does he have to pay me back?

I closed my case with the D.a. against my daughters father. He signed a paper stating that he would continue to pay me monthly plus pay me the moneies owed at the time of the closure of the case against him. I have recently reopened my case with the D.A. since he has not been paying. My Question is can I take him to court and what kind of case would it be to get the $17,000 that he owes me. That is how much he signed the paper stating that he would pay back from back child support when I closed the case with the D.A. Do i even have a case against him?

If signing off on the DA collection does not mean the the child support case was dismissed at the Superior Court, which it most probably was not based upon your description, he owes you the back support plus simple interest at the rate of 10%. The DA (of now Department of Child Support Services, DCSS) should collect the back pay and the interest. If he has assets which can be levied against and you want quicker action you can hire an attorney. Good Luck, Pat McCrary
