Legal Question in Family Law in California

Paying child support w/ no court order

My husband has a child who is 12 yrs old from a previous relationship, they were never married. They split up when the child was 2. He has paid child support faithfully for the past 10 yrs. They never went to court so the amount he paid (pays) was decided by her based on what her ex-husband paid for her other two kids. About 1 1/2 years ago she decided he wanted $50 more a month which my husband agreed to. My question is would he be better off going to court and getting a court order or should we just keep things the way they are. What would be the pros and cons of going to court and what would it cost appox to do so. Thank you in advance for your help.

Re: Paying child support w/ no court order

In order to answer that question you should determine guideline child support for the child. There are a number of sites on the web that will do that. Better yet you should get a consultation with a family law attorney who can make the calculations and discuss all of your husband's rights and responsibilities. Good Luck, Pat McCrary
