Legal Question in Family Law in California

Paying for a child's education

Last year I was granted both legal and physcial custody of our four year old son with some visitation granted to my son's father. However, since that time my son's father has continued to threaten to take me back to court to reduce the amount of child support being paid. He now pays $599.00 a month with $350.00 of that amount going to daycare expenses. He has written me numerous letters and has had family members call me to ask me to stipulate to a reduction in child support. I have refused and asked if we could avoid court and discuss a reduction after my son began school. My son is ready to start school this year and I have decided to place him in public school for one-year and the following year I would like to place in a catholic school. My question is if we go back to court what are my rights in regards to having my son's father help pay for my son's education. Also, he currently recieves a reduction in the amount that he is currently paying because he is claiming that his other child from another relationship is living with him. I have been led to believe that this is not true although I have kept this claim to myself. What is the best way to prove legally that this not true?

Call the local district attorney's office they should be able to give you the number for the local agency that enforces child support orders. They will advise you regarding the possibility of his receiving a reduction in the amount of child support paid.

The child's father is not responsible for paying for private school. However, you may be able to get the equivalent of child care, and use it to help for the private school.
