Legal Question in Family Law in California

payment on divorce judgments

My divorce was final in Mar 1999, through Vista, Calif. courts. I was awarded a judgment amount of $2000 that my ex-husband needs to repay to me in relation to a joint credit card we had. Since Mar 1999, I have only collected $410, his last payment being made to me in Nov 2001. Please tell me exactly what I need to do now to collect this money that should have been paid in $50 increments every month. Do I need to hire another lawyer to file in Family court? I can't afford this, I paid the original divorce out of my own pocket. Can he have his wages attached?

Re: payment on divorce judgments

Yes, you currently have a judgment against him that you must collect. If he is working you can attache his wages and if you know where he banks you can attache his bank account. Obtain a Writ of Execution from the court and then have the Sheriff execute against his assets and wages. Good Luck, Pat McCrary
