Legal Question in Family Law in California

who pays

If my husband got a credit card in his name only while we were married and he is the only one who put purchases on it. My name is not on the application or anything. Am I responsible for any part of that debt? Or vice Versa

A credit card debt can be community even if your name is not on it unless it was used for something that did not benefit the community. You should get copies of all the statements to see what it was used for. Gambling or porn are classic expenses that do not benefit the community. Even if the debt is community, if the debts exceed the assets you may ask the court to assign more than half of the debt to him. If the debt is community and there are more assets than debts the court must make an equal division of the assets and debts.
