Legal Question in Family Law in California

Can paystubs and unemployment payments be subpoenaed in a divorce/child support case? My Ex is hiding earnings and is currently paying no support, not even half of our daughters childcare costs, he also has made no attempt/effort to see her, or even call her since he voluntarily left, am I left to pay everything until a judgement is made, and will they retro back what he owes?

Paycheck stubs and unemployment records can be subpoenaed. Unless there is a current child support order, except is a few narrow circumstances cannot be ordered retroactive. Enforcing an existing child support order can go back as far as there is unpaid child support. You should consult with an attorney to clarify your position.
