Legal Question in Family Law in California

Perjury to obtain imputation of income

I am in a very difficult case in which the Plaintiff continues to lie before the Judge and get away with it. First she falsified a Marital Settlement Agreement and I go it Set Aside; her latest is she lied to get my income imputed making statement she knew were false and yet the Court does not wish to set aside the imputation of income despite the demonstrable perjury. What can I do?

Re: Perjury to obtain imputation of income

Imputation of income is a complex area of law. Some judges will use wide discretion unless checked by the citation of proper cases. I suggest that you retain an attorney to place the appropriate evidence and law in front of the judge. Good Luck, Pat McCrary

Impeach her creditability on cross examination. Judge sets orders based on evidence, so you may want to fill the record with creditable evidence.
