Legal Question in Family Law in California
permission to move? or adoption
My husband and I want to move down to southern California to be closer to his ailing mother. I have 2 children from a pervious marriage. My husband had planned on adopting them but now we fear we might not have enough time to wait for the process to be completed.
In my child custody orders the only way I can move out of my area is with written consent from my Ex or a court order. My Ex has expressed to us that he approves of the Adoption and gives his consent.
My question is what would be the best course of action to help expedite the opportunity to move? I want to avoid any future issues as much as possible. Would it be better to go ahead and file for the step-parent adoption and if so is there any way to make the process go faster or would it be better to just ask if him if he will write a letter to allow us to move and if so will it have to be notarized and filed with family court?
I know my Exs main concern is that he doesnt want to pay Child Support anymore. Maybe if we stipulate that I would close the child support order at the time of relocation?
Please help. Thank you.

Re: permission to move? or adoption
You need to talk to an attorney right away so that you can plan the move or file the motion. There isn't enough information that we can gather through an internet site to give you an answer on this complex issue. We aren't just dealing with the law, we are dealing with people. Good Luck, Pat McCrary
