Legal Question in Family Law in California

Do I need permission from the non-custodial parent to move out of the state?

Ex boyfriend/Non-custodial parent has not had contact with our daughter since she was 4 (she in now 11). My current husband & I have been married for 7 years and we are a military family. We must move from the Naval base in San Diego to a new duty station is San Antonio,Texas. There is no court order between my ex & I. No child support case open. So do I still need his permission?

If there is no order in place, you do not need to gert permission or get a court order. It is always safest to get an order. I suggest that you get a consultation with a family law attorney who handles move-away cases. I would suggest that you would almost certainly get permission from the family law court to move, but there is a cost. Good Luck, Pat McCrary
