Legal Question in Family Law in California

Do I need permission from other parent to move out of state?

Non-custodial parent and I were never married. He has not seen our daughter in seven years. All child support cases have been closed for several years. There is no visitation or custody order. In a two months, my husband (of 7 years) & I have will have to move from California to Texas because my husband is military.

If there are no custody orders you are free to move. To be certain you should pull any court case that has been filed concerning the child and check the orders. If the Father did file an action you do run the risk that the court could order you to return while the matter is heard by the court, however, that risk I would consider slight. It is unlikely that a Father who is not paying support would stir the pot with a likelyhood that he could not win and would end up paying support. Check for court orders first. You can go online to the court website and do a search by the Father's name for any cases that have been filed. Good Luck, Pat McCrary
