Not automatically, no. But if a person is incarcerated and it is expected to last for a period of time, the other parent may readily be entitled to a temporary order of sole custody -- but nothing happens if they don't pursue it (absent CPS or DCFS getting involved). If they do, that doesn't mean the imprisoned parties' rights terminate, it just means that that party, once out, has to jump through the hoops to get their legal right restored so that they can participate in raising the kid(s). One just has to understand, it's a process, it requires time and effort, and can be achieved, but not without some hard work.
