Can a petition to terminate parental rights and adoption PC 1516.5 be filed when there is an active and open case in probate guardianship for reunification between mother and son. Grandparent being the guardian?

Yes. 1516.5 is specifically for a case where there has been a guardianship in place for more than 2 years.
