First, child support and visitation are different things, so while your child's mother owes you child support (and then some) she is still legally entitled to visitation. However, you have not identified the reasons for her long absence from your child's life. I recommend that you consult with a family law attorney and if possible file and emergency order for modification of the visitation schedule to allow for only supervised visitation at least until your son and his mother have had an opportunity to get acquainted with one another. This would also be an issue to take to mediation. As long as there is a court-ordered that has not been modified or adjusted, those are the guidelines that need to be followed until of course you get things changed to fit the present circumstances. Good luck with this.
