Legal Question in Family Law in California

How soon can I get physical custody once my unborn baby is born? The mother is being difficult and says she is only breastfeeding and if I want to see the baby it would have to be at her house for a couple of hours. I am not comfortable going to her house. We are not together anymore. I would like to have the baby at my house because if she is around I know she won’t let me learn how to take care of the baby.

You two have 18+ years ahead of co-parenting, which is going to require a lot of cooperation and compromise. Best to start now. There is no hard and fast rule as to when a newborn can be in the father's sole custody. If the two of you can't reach an agreement, you'll have to ask a judge to decide on a parenting schedule and plan, but every family law judge in the state will tell you that you don't want them to make those decisions for you. No matter how much evidence is put forth at the hearing, they can never know what's best for your child the way you can in your heart.
