Legal Question in Family Law in California

My ex is not playing with a full deck.I need my son back!

AFter taking me to court for every little thing he wanted to last September my ex was granted his motion to have my son switch schools and live with him during the week. The reason for this was due to the tardies he had while in my custody. We have been to court over and over and he finally won..A few weeks ago we had a dispute on whose weekend it was.I ended up keeping my son for the weekend dispite his calling the police twice. When my son had to go back to his house after school on Monday he went home and his dad had turned down all the pictures of my son, told him he's a failure and that I am a drug addict. And felt the need to tell my son that his grandpa(my father)is going to die very soon.He enjoys looking people up on his computer and runs everyones plates that are parked in front off my house. I had someone over from Avon because I was interested in selling it, well I guess this girl had prior drug charges. That is why he says I am on drugs.Yes my dad has a bad heart but is not going to die anytime soonH he also took a hammer to my sons playstation. This is juat the small of it..At next hearing can my son talk with the judge yet, he is 10? I want him back so bad ,his dad plays the game well and is very sneaky.Any suggestion

Based on that incident that you describe you should file a motion. Depending on the procedures in your county, the child probably cannot talk to the judge, but you may be able to have an attorney appointed for him, or have a child custody evaluator appointed or have Family Court Services talk to the child. Since your husband "plays the game well" you need an attorney who can also play the game. Good Luck, Pat McCrary

In a general sense, it is not likely that the judge will speak with your son. You can ask the judge to appoint an attorney for your son, and the attorney will be your sons' voice in court.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
