Legal Question in Family Law in California

Points and Authorities

What does it mean when something is filed that says ''Points and Authorities''.

Can you go to a location on the internet to view documents that have been filed on other people's family law cases if you have their case number ?

If something has been filed within the last month, would it be in the file that the public has access to downtown ?

This is in Los Angeles County.

\Thank you.

Leslie.

Re: Points and Authorities

1) A memorandum of points and authorities is more or less the legal case precedents and/or laws that the judge will review to make his/her decision on a pending legal issue. If you are the one preparing the document, you try to find the best laws/precedents that work in your favor as well as the ones that rebut any possible arguments the other side has. Such a document must be prepared on pleading paper before being filed.

2) Certain court documents are deemed public record, in which you or anyone can view. However, other documents may be only accessible by the parties' case number, etc...

3) Some courthouses work more efficiently than others in providing the parties or general public access to records. So, you would have to inquire with a clerk at the specific courthouse at issue when such records may become available to you.
