Legal Question in Family Law in California

What happens when police make a mistake

I'm the mother in a custody battle. The father in order to gain custody called our local ploice and said there was a restraining order against me and our child. he lied there never was a restraining order. The police didn't ask to see a certified copy of the restraining order, they took his word and detained me and gave my son to him, saying I was in violation of a court order. I have not seen my son since. What advice do you have?

You need to immediately file a motion to change the visitation order. Request that he have supervised visitation. Also file a complaint with internal affairs about the improper conduct of the police officers.
