Legal Question in Family Law in California

What are the possibilities?

Mother in CA has court ordered sole, legal custody with no visitations to father.

Child is 14 months old. Child and father have never seen each other in person.

Father is in NC. Fathers wages are garnished for child support. Mother and father have attempted to communicate although the father is volatile, and his character is very unstable.

Father wants to fight mother for visitations. Whats the possible outcome here?

Re: What are the possibilities?

The answer to your question depends to some extent on the county you reside in and the individual person who reviews the case and makes the recommendation. It would seem unlikely that he would get overnight visitation. However, you should check for a criminal record in NC. If he has conviction for violence then his chances of getting unsupervised visitation is greatly reduced. Get a certified copy of the court order giving you sole legal and physical custody of the child. Keep this document where you can easily get it in case he attempts to take the child. Until he takes some action he will get only that visitation which you agree to allow. Any visitation you allow will set the pattern for future visitation.
