Post nuptial agreement -- is it possible ?
Hi, I did marry my husband less than 5 years ago in Las Vegas, Nevada, and we live now in California. When we married we did not do any pre nuptial. I would like to know now if there is a way to separate financially as I discovered my husband has difficulties to be financially responsible and that I end up paying for most of our living. I would like to protect myself in case of heritage or any goods that I could have from my family. I also would like to know if, in case of divorce, I have to give him half of everything that I paid during these 4 years and 8 months. Please email me with your rates, I am self employed. Thank you.

In order to obtain the information you are seeking, you would have to provide more information. In a general sense, marital assets and debts are divided equally. You should not have to "give him half of everything you have paid" unless you were accumulating assets.

Property that you recieve as a inheritance or a gift is your separate property. To reduce the possibility of the community obtaining an interest in the property keep it completely separate from your wages and other community property. You should review this with an attorney to develop the best approach for you to protect your separate property.
