Legal Question in Family Law in California

Do I need post-nuptial agreement drawn up?

Hello-

I have an uncontested divorce case pending a hearing coming up soon. I also have a grant deed in my name only. We have no issues to settle. I basically paid for everything, mortgage, furnitures, car, etc..She does contributed anything to the marriage. Do I need an agreement just to make sure the judge will let me keep my property? Thanks

If everything is agreed the easiest method is to have an attorney prepare a marital settlement agreement. The judges rarely question those agreements. Good Luck, Pat McCrary

If you have real property, I doubt this is properly an uncontested case. What you may mean is that you have her default. If so, you can submit a default judgment. Otherwise (if you don't have her default) a marital settlement agreement would be in order.

Either way, I am available for a free consultation and my rates are very reasonable.
