Legal Question in Family Law in California

Post-Nuptial vs. Transmutation

What is the difference between a post-

nuptial and a transmutation

agreement? How well does either one

stand against the Court, creditors, or

collectors for a pre-marital liability?

Re: Post-Nuptial vs. Transmutation

In a general sense, a Transmutation Agreement changes the characted of community property to separate property, or separate property to community property. A Post Nuptial Agreement is similar to a pre nuptial agreement and addresses more issues and in more depth.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
