Power of Attorney
My brother in-law is in the hospital. His oldest son has said that someone has telling him that the next of kin is my husband because he is the brother. His son however is the one making all the decisions where health care and everything else is concerned. My husband is a 1/2 brother though, is he still the next of kin before his son? We want to change it if that is the case so that his (my brother in-law) son can have all the legal power neccessary to make those decisions for his father. Do we need to fill out a power of attorney giving the son the power to make those decisions? The son has given all the permission at the hospital to do all of the neccessary testing and such already.
