Power of Attorney & Marriage

Currently my fiance is incarcerated and his mother has legal power of attorney. Once we are married does the power of attorney become void or do we need to do something to remove her as power of attorney?

At least the person you are marrying isn't one of the Menendez brothers.

The incarcerated individual may revoke the power of attorney held by the mother if he or she so desires, and if he or she so desires can then execute a power of attorney in your favor. None of these steps happens automatically.

In general, beware of being scammed on -- prison is a school where people learn to run con games on other people.

power of attorney can be revoked at anytime by the grantor of such power. if your fiance wants to revoke this legal instrument at this time, he may do so legally, but should make sure it is done correctly. you and/or he may want to have an affordable attorney take care of this for you. contact us today for such assistance.
