Re: power of attorney for a minor child

The young man may intend to function as an emancipated minor, but in dealings with the state and other governmental agencies it will be much better if you have evidence of actual custody. If the boy's parents sign a Stipulation and Consent to a change of custody and file it with the court along with an Order granting you custody, and the stipulations provide good reasons for the transfer of custody, a Circuit Court judge will almost certainly sign the order giving you custody. I would advise you to ask the court clerk for a triple sealed copy of the signed order, which may be necessary in another state to be accepted as valid.

I would also advise you, or the boy's parents, to ask a lawyer to prepare the papers for the court. It is not a complicated matter in most cases and should not be expensive. There will be a filing fee for the court, too, but the total cost should not be prohibitive.
