Power of attorney
before my son left for the gulf he gave me power of attorney. he appointed me as attorney in fact. now he gave me power of attorney for his 2 yr old daughter but my grandson wasn't mentioned because he wasn't born yet. now he also says that all business transacted for him in his name i am the attorney in fact. the problem is his wife has left and i have both kids and i want to know if i legally have any right to his money in the bank to care for the kids. she is probubly out gambling and thier may not be any money left she has been gone since friday afternoon and i haven't heard from her since.

It is difficult to give you firm answers without first reviewing the documents in question. You may want to consider a guardianship proceeding, so that you can make legal decisions regarding the children.

You need to communicate with the father as quickly as you can regarding these matters. If mom does not return quickly, may need to take action on behalf of your grandkids. If mom returns, may wish to get power of attorney from her prior to taking other action. 800-685-6950
