Legal Question in Family Law in California
Power of Attorny
My husband is in the Hospital on a ventilator. He is unable to speak or write. He is able to respond by nodding his head. We were going to refinance our home before he became incapacitated. He is agreeing to give me Power of Attorney but would be unable to sign a form. I would like to know how I can obtain Power of Attorney or even if I can get temporary Power of Attorney

In a general sense, you need his signature for a Power of Attorney. You might consider asking the court to appoint you as his conservator, which would allow you to make legal decisions on his behalf.
For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
