Legal Question in Family Law in California

I am pregnant with a man that is not my husband. I am still technically married to my husband. I heard that when the baby is born, I cannot put my (non-husband) on the birth certificate, even though he is the father. What is the law regarding this in California?

Under California law a baby born during a marriage is presumably the spouses. This of course is a rebuttable presumption.
