Legal Question in Family Law in California

Pre-marital debt

My fiance owes back pay on his child support and also has an outstanding student loan that he owes on. If we get married am I going to also be held responsible to pay on these debts? Can my wages and/or tax refunds be garnished to pay for these personal debts? Also, how will this affect my tax filing?

Your wages cannot be attached for the debts. If you file a joint income tax return with him they can take the refund. They can attach any jointly held assets. It sounds like you should talk to an attorney about a pre-marital agreement in order to protect yourself. Good Luck, Pat McCrary
