Legal Question in Family Law in California

premission for travel outside of US

Do I need permission from my exhusband for travel for my son (age 6) oitside of the US to Belize with me? My exhusband has signed the paperwork for the US passport and my son has been to Belize 3-4 times already. (My husband of 10 months is from Belize, we have a 2nd home there and we are going to visit family for one week.) We have a settlement agreement wherein we share legal custody. We also share physical custody and my ex has my son every other weekend and overnight every wednesday. The document is silent with regard to 'travel permission'. My Ex has told me that I cannot take my son out of the country without his permission (permission he has granted in the past) and that he would ''have me arrested'' if I took my son out of the country. Not sure on what grounds? Please advise....THANKS!

Re: premission for travel outside of US

As a general rule giving notice to the other parent of a trip out of the area, especially out of the country, you should as a matter of courtsey give him notice of the trip. As to getting his permission you should probably take the safe route and get his permission. If he hassles you regarding permission then go to court and request a modification to allow these out of the country trips for a short period of time. You should review the order and the facts of your case with an attorney.
