With the prenup do you need a witness or do you just fill out paperwork and that be all with the signatures of both spouses

There are several formalities with a pre-nup. Witnesses or a notary are strongly preferred. Also, some provision may not be valid without an attorney for both parties. It is best to consult an attorney. Good Luck, Pat McCrary

Witnesses are not required. A notary is not required, unless you plan on having the prenuptial agreement recorded. What is essential to the validity of a prenuptial agreement is set forth in Family Code section 1615.
