Legal Question in Family Law in California
Do I need a prenuptial agreement?
I am newly engaged. I do not want to get a prenuptial agreement, but I'm not sure if it's necessary. I have an IRA and some stocks and mutual funds(that I was able to purchase with money from an inheritance) at a finance company. Since I have these items prior to our marriage, would my partner have a right to a portion of these funds if anything was to happen? I am more protective of this money because the bulk of it is from an inheritance from my close family member.

EVEN THOUGH ANY PROPERTY INHERITED BY YOU IS CONSIDERED SEPARATE PROPERTY, BUT TO PROTECT YOURSELF YOU MUST EITHER TAKE GREAT STEPS TO KEEP THE FUNDS/STOCKS SEPARATE AND DO NOT COMMINGLE WITH COMMUNITY FUNDS/STOCK OR THE EASIER WAY IS TO HAVE A PRE-NUPTIAL AGREEMENT LISTING THE PROPERTIES. I dont think so. There is nothing wrong with having one but you dont want one just make sure you keep the accounts in your name and dont mix your separate and your community assets. Dont add to these accounts after you marry, open new joint accounts to invest your community money in.
