Legal Question in Family Law in California

Prenuptual agreements and summary dissolutions

I am getting a summary dissolution of my marriage (been married since sept 1999). I am doing my own divorce for the most part, but I do not know how a prenuptial aggreement will apply to the paperwork process. will I have to complete a marriage settlement aggreement? The divorce itself is simple-we both want it, and she is not interested in any of my assets. We agreed to keep everything separate, and we have. what are the form #'s that this will apply to? (ie 1281-petition, etc). I am stuck with the petition thus far, because i am uncertain in which direction to proceed. I have two divorce books, but none of them really mention prenups, which surprised me in this day and age. Thank you for your help!!!

Re: Prenuptual agreements and summary dissolutions

The Summary Dissolutin is used for couples that are married less than five years, have no minor children from the marriage, and have properties (assets and debts) less than $25,000.00. Thus, you may want to check the requirement for filing under a Summary Dissolution befor you proceed. since you may not be eligible due to your assets that need to be referred to, confirmed, divided or disposed of in the judgment of dissolution.
